**9.User-Submitted Content and Intellectual Property**

1. Customer Ownership and Representations

   • By uploading, submitting, or providing any images, logos, graphics, text, quotes, scriptures, or other content (collectively, "User Content") for personalization on DM+HH™ products, you represent and warrant that:

     • You are the sole legal owner of the User Content, or you possess all necessary explicit licenses, rights, consents, and permissions to use and reproduce the content.

     • The User Content does not infringe upon, violate, or misappropriate any third-party copyrights, trademarks, publicity rights, privacy rights, or any other proprietary or intellectual property rights.

     • The User Content complies with all applicable local, state, national, and international laws.

2. Indemnification and Liability

   • You agree to indemnify, defend, and hold harmless DM+HH™, its owners, employees, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to any breach of these warranties, or any third-party claims of copyright or trademark infringement resulting from the production of your custom order. DM+HH™ acts strictly as a printing and manufacturing service and assumes no liability for verifying the legal ownership or trademark status of user-submitted designs.

3. Right of Refusal and Order Cancellation
   DM+HH™ respects the intellectual property rights of others and reserves the right, in its sole discretion, to reject any order and cancel any transaction containing User Content that we suspect may violate copyright, trademark, or intellectual property laws. This includes, but is not limited to, the unauthorized use of professional sports team logos, Disney characters, celebrity likenesses, or trademarked brand names. If your order is canceled under this provision, a full refund will be issued, and you will be notified via email.

**10. Limitation of Liability**
To the fullest extent permitted by law, Devoted Man for Him & HER shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the site or purchase of products.

 

*11. Governing Law**
These Terms shall be governed by and construed in accordance with the laws of North Carolina/Wake County, without regard to its conflict of law principles.

 

**12. Phone Number Permission**

By providing your phone number in our contact form or at checkout, you consent to receive text messages from Devoted Man for Him & HER regarding responses to your inquiries, account updates, and other relevant information. Message frequency will vary. Message and data rates may apply.
